*** Bill 115 Remedy Agreement ***

As part of the remedy, the Crown has agreed to make a payment to all affected OSSTF-represented teachers and education workers to compensate for lost or reduced sick leave credit gratuities, as at August 31, 2012, which is calculated as follows:

· $604 to each OSSTF represented employee who had vested sick leave credit gratuities which were to be paid out upon retirement; or
· $1,208 to each OSSTF represented employee who had non-vested sick leave credit gratuities or service gratuities for which they received a wind-up payout.

The ministry expects such payments to be made by relevant school boards as soon as practicable and preferably by no later than the October 1st, 2017 payroll. For employees who are not at work when the payment is to be made, the school boards can defer the payment to the first pay period when the employee returns to work.

Payments to OSSTF-represented former employees who retired from a board after August 31, 2012 are to be made by November 1st, 2017, wherever possible. OSSTF local bargaining units will endeavor to provide the necessary information to school boards to ensure all impacted retirees are included. The boards should allow up to the end of the 2017-18 school year for retirees to come forward.  RETIREES should contact HR at the UCDSB as soon as possible to ensure they get compensated.

OSSTF-represented employees who have resigned from a board for any reason should receive their payment from the board in which they had a vested sick leave credit gratuity or received a non-vested sick leave credit gratuity or service gratuity payout. OSSTF-represented employees that have resigned from a board will be expected to contact their previous board by September 30, 2017 to receive their payout by November 1, 2017.  Teachers/PSSP who have resigned should contact HR at the UCDSB as soon as possible to ensure they get compensated.

Payments to eligible OSSTF-represented employees who have since died are to be made to their estate.

New hires after August 31, 2012, or employees with no access to a sick leave credit or service gratuity prior to August 31, 2012 are not eligible for this payment.
